Full Terms and Conditions*

By selecting “I agree to Terms & Conditions” when booking a retreat you, the “Participant,” are agreeing to the following Terms and Conditions from the “Company,” Retreat in the Pines LLC. The “Retreat” refers to the scheduled Retreat date that was selected during the booking process.

I, the Participant, agree to the following terms and conditions outlined below.

I represent that I am in good physical health and do not suffer from any medical conditions that would cause harm to myself or others at the Retreat. I understand that it is my responsibility to inform the Company of any limitations and, if needed, consult with a physician regarding my participation in any Activities prior to the Retreat.

I understand that I must be at least 21 years of age to participate in the Retreat.

CODE OF CONDUCT

I understand and agree that I will not:

1. Harass, harm, threaten, discriminate, libel, defame, or otherwise shame and/or injure the Company, its owners, employees, and contractors as well as all fellow Participants at the Retreat. 
2. Infringe copyrights, trademarks, service marks, or any other intellectual property rights associated with the Company.
3. Falsely misrepresent myself as a Participant.
4. Falsely misrepresent the Company or the Retreat in any form such as, but not limited to, written or spoken words, photos, videos, and recordings taken by me and distributed toward another Participant or persons.
5. Reproduce, alter, distribute, display, publish, re-sell, share via photo, video or otherwise, all exclusive content distributed to me at the Retreat.
6. Violate any Program guidelines, rules, and agreements at the Retreat.
7. Disrespect any fellow Participants, including but not limited to sharing information, photos, videos, etc. without consent.

I understand and agree that the Company has the right to immediately expel, without refund or transfer of any kind, any Participant who breaks this Code of Conduct.

PRIVACY AND PHOTOS

The Company will use the Participant’s email and payment information for the sole purpose of the Participant's purchase(s) from the Company. The Company will not display, sell, or share the Participant’s information to any outside party, in perpetuity. 

I agree to be photographed and recorded by the Company unless I expressly state to my Retreat Leader and the Company that I do not want to be photographed and recorded. I understand that it is my responsibility to communicate any desire to not be photographed or recorded. I hereby irrevocably authorize the Company, its owners, employees, and contractors to copyright, publish, reproduce, exhibit, transmit, broadcast, televise, digitize, display, otherwise use, and permit others to use:

• The Participant’s image, likeness, voice, and name.
• All photographs, recordings (voice or video), writings, statements, and quotations of or by the Participant (collectively referred to as Materials) may be used by the Company in any manner, form, or format whatsoever now and hereinafter created. 

I understand that all Materials:

• Are the property of the Company.
• May be used by the Company without further consent or payment to the Participant at any time for the advertising and promotion of the Company.

The Participant agrees not to contest the rights or authority granted to the Company and interminably indemnifies and holds harmless the Company, its owners, employees, and contractors from any claims, actions, damages, liabilities, costs, or demands whatsoever arising by reason of defamation, invasion of privacy, right of publicity, copyright infringement, or any other personal or property rights from or related to any use of the Materials.

This consent is given in perpetuity and does not require prior or future approval by the Participant.

RELEASE OF LIABILITY

I waive and release the Company, its owners, employees, and contractors from any claim, demand, and course of action of any kind resulting from or related to the Retreat. In taking part in the Retreat, I understand and acknowledge that I am fully responsible for any and all risks, injuries, or damage, known and unknown, which might occur as a result of participation in the Retreat.

I am voluntarily participating in the Retreat and I am aware of the risks associated with traveling to and from the Retreat and participating in the Retreat, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I understand that these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to travel; or the condition of the Retreat location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in the Retreat, including travel to, from and during the Retreat.

On behalf of myself and my next of kin, heirs, and representatives I release from all liability and promise not to sue the Company, its owners, employees, and contractors for any claims, including claims of negligence,  physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death that I may suffer because of my participation in the Retreat, including travel to, from and during the Retreat.

I agree to hold the Company harmless from any and all claims, including attorney’s fees or damage to my personal property that may occur as a result of my participation in the, including travel to, from, and during the Retreat. If the Company incurs any of these types of expenses, I agree to reimburse the Company. If I need medical treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

PAYMENTS AND DISCOUNTS

I understand that a deposit of 50% of the total is required to book a spot at the Retreat. I understand that the deposit is non-refundable under any and all circumstances. 

I agree to pay the balance at least one month before the Retreat. I understand that if I do not pay the balance at least one month before the Retreat, the Company has the right to revoke my spot at the Retreat without any refund or credit.

I understand that discounts are non-transferable and only apply to the original booking, they can’t be combined with any other offer, and can’t be applied to an existing booking. 

CANCELLATIONS, TRANSFERS, AND TRAVEL INSURANCE

It is the responsibility of the Participant to read and understand these terms and conditions prior to booking the Retreat.

I understand that all payments are non-refundable.

If the Retreat is more than 60 days away and the Participant has paid in full, the Participant can either:

1. Find a replacement guest to come in place of the Participant, transferring all monies paid to the replacement guest; OR
2. Request an e-gift card for the amount paid, less the non-refundable deposit.

If the Retreat is more than 60 days away and the Participant has only paid the deposit, the Participant can find a replacement guest to come in their place, transferring the deposit to the new guest. The new guest would be responsible for paying the balance due.

If the Retreat is less than 60 days away and the Participant has paid in full, the Participant can find a replacement guest to come in place of them, transferring all monies paid to the replacement guest.

I understand that in order for a transfer to be accepted, I must make the request via email at least 24 hours prior to the Retreat start date. 

I understand that it is the Participant’s responsibility to be aware of what dates are 60 days, 30 days, and 24 hours before the Retreat start date. 

I understand that e-gift cards are non-refundable, do not expire, may be used by anyone, and are emailed to the person who booked the Retreat.

We strongly advise you to purchase the appropriate travel insurance to protect your investment and to read the policy carefully to ensure it provides suitable coverage.

I understand that it is highly recommended to purchase travel insurance. I understand that events including but not limited to adverse weather, tornadoes, fire, lightning strikes, road closures, travel restrictions, closures due to COVID or other public health issues may occur that may cause my travel arrangements to be affected.

I understand that no credits or e-gift cards are issued for failure to attend, failure to complete the retreat, arriving late or leaving early.

I understand that if I contract any contagious illness, including but not limited to COVID, and am not able to attend, there will not be a refund or credit and I will need to work with the current cancellation policy as well as my travel insurance options. 

If I am unable to make the Retreat for any and all reasons, including those that are COVID-related, it is my responsibility to ensure my travel insurance coverage is sufficient.

In the event that the Retreat location is affected by events including but not limited to adverse weather (such as snow, ice, or flooding) and the Company deems it necessary to cancel the Retreat, the Participant will be offered a credit or refund for the canceled Retreat. 

PRIVATE ACCOMMODATIONS

I understand that if I have reserved a “private” accommodation with at least one other Participant who cancels, I will be responsible for an additional fee to keep the private accommodation. 

OTHER TERMS

I understand that I am to drink responsibly at the Retreat. I understand that illegal drugs are prohibited at the Retreat. 

I understand that the Company reserves the right to ask me to leave at any time during the Retreat.

AGREEMENT

I, herein stated as the Participant, have read the above Terms and Conditions and fully understand them in their entirety content. I voluntarily agree to and accept all terms and conditions stated and am legally able to sign via digital authorization by checking the box stating “I agree to Terms and Conditions” when booking.
